Purpose and Scope
This Partner Operating Standards policy is issued by Chubby Club LLC (“Chubby Club,” “we,” “us,” or “our”) and sets forth the operational requirements that each participating Location must meet as a condition of participating in the Program. This policy applies in the United States and Canada.
Definitions
- Member means an individual enrolled in the Program through the Chubby Club App.
- Partner means the business entity that has entered into the Partner Terms (MSA) with Chubby Club under a signed Order Form.
- Location means each venue operated by or on behalf of a Partner and identified in the applicable Order Form as participating in the Program.
- Program means the Chubby Club loyalty program, including the PLUS membership tier, operated by Chubby Club.
- Order Form means the signed ordering document between Chubby Club and a Partner that identifies participating Locations and sets forth the economic and transaction-specific terms of participation.
- Valid Redemption means a redemption presented through the Chubby Club App or partner portal that has not expired and complies with the Points Earning & Redemption Rules.
- Chubby Club App means Chubby Club’s consumer-facing mobile application and associated member-facing services.
1. Marketing Materials and In-Store Display
Each Location must:
- Display all Chubby Club marketing materials provided to it — including signage, table tents, window clings, digital displays, and promotional collateral — in prominent, customer-facing positions.
- Keep displayed materials current, in good condition, and replace or update them promptly upon Chubby Club’s request.
- Acknowledge Member benefits on menus or signage where the Location’s format reasonably permits.
- Authorize Chubby Club to use the Location’s name, logo, and branding in Program marketing for the duration of the Location’s participation in the Program.
2. Co-Marketing and Social Media
Each Location will:
- Participate in reasonable joint promotional campaigns and co-branded initiatives organized by Chubby Club.
- Engage with Chubby Club social media content, including sharing and reposting Program-related content through the Location’s channels.
- Provide photos, video, or testimonial materials for Program marketing, subject to the Partner’s prior approval, which will not be unreasonably withheld.
- Participate in special events designed to drive Member engagement.
Co-marketing obligations under this Section 2 are subject to the Location’s reasonable availability and operational capacity, and Chubby Club will provide reasonable advance notice of campaigns and events.
3. Staff Training
- Each Location must begin initial staff training within 30 days of the effective date of its participation under the applicable Order Form, and must provide ongoing training updates as the Program evolves.
- Loyalty Program training must cover points earning, redemption processes, Member assistance, Program benefits, and support contact procedures.
- PLUS Program training must cover PLUS features, Member verification, honoring PLUS benefits, and presenting PLUS enrollment to guests on-site.
- Each Location must enforce staff compliance with this training and ensure consistent delivery of the Program across all staff, shifts, and service periods.
4. Benefit Fulfillment
- Each Location must honor all Member perks and redemptions processed through the Chubby Club App, and must fulfill Member benefits promptly at the time of a Valid Redemption. Any specific fulfillment windows applicable to a Location are set forth in the applicable Order Form.
- Where applicable to the Location’s format, the Location must provide Members with priority access to reservations.
- Benefit delivery must be uniform across all staff, shifts, and service periods. A Location may not impose location-specific or shift-specific restrictions on benefits beyond those established by Chubby Club.
5. Exclusivity
While participating in the Program, a Location may not promote or participate in any competing third-party loyalty, points, or paid-membership platform, or sell paid memberships outside the Chubby Club ecosystem. A Partner may request a written exception from Chubby Club at legal@chubbyclub.com; exceptions are effective only if granted by Chubby Club in writing.
6. Enforcement
Failure to meet the standards in this policy is a breach of the Partner Terms (MSA) and is subject to the notice, cure, and termination provisions of the Partner Terms (MSA). Chubby Club may also suspend a Location’s participation in specific Program features while a material failure remains uncured.
7. Support and Escalations
Questions, exception requests, and escalations relating to this policy should be directed to legal@chubbyclub.com or submitted through the partner portal.
8. Changes to This Policy
Chubby Club may update this policy from time to time. Material changes will be communicated to Partners through the partner portal or by email at least 30 days before they take effect, except where a shorter period is required to address fraud, security, or legal compliance. The “Effective date” above reflects the current version. Continued participation in the Program after a change takes effect constitutes acceptance of the change.
9. Relationship to Other Agreements
This policy is incorporated by reference into the Partner Terms (MSA) and applies to each Location identified in, and as provided by, the signed Order Form. In the event of a conflict, the order of precedence is: the signed Order Form, then the Partner Terms (MSA), then this policy.
