Purpose and Scope
This Platform Requirements policy is issued by Chubby Club LLC (“Chubby Club,” “we,” “us,” or “our”) and sets forth the technical and operational requirements for connecting participating Locations to the Chubby Club platform, together with Chubby Club’s support commitments. These requirements complement the SaaS Terms, which govern use of the platform itself. This policy applies in the United States and Canada.
Definitions
- Member means an individual enrolled in the Program through the Chubby Club App.
- Partner means the business entity that has entered into the Partner Terms (MSA) with Chubby Club under a signed Order Form.
- Location means each venue operated by or on behalf of a Partner and identified in the applicable Order Form as participating in the Program.
- Program means the Chubby Club loyalty program, including the PLUS membership tier, operated by Chubby Club.
- Order Form means the signed ordering document between Chubby Club and a Partner that identifies participating Locations and sets forth the economic and transaction-specific terms of participation.
- Valid Redemption means a redemption presented through the Chubby Club App or partner portal that has not expired and complies with the Points Earning & Redemption Rules.
- Platform means Chubby Club’s loyalty platform, including the Chubby Club App, the partner portal, and associated integrations and services.
- Platform Data means patron profiles, loyalty activity, transaction metadata, redemption history, and analytics generated by or through the Platform.
1. Point-of-Sale (POS) Integration
- Each Location must provide and maintain a supported POS integration for real-time transaction capture. The current list of supported POS systems is maintained in the partner portal and may be updated by Chubby Club from time to time.
- Each Location must grant Chubby Club the API or administrative access to its reservation, waitlist, and POS systems reasonably necessary to operate the integration, and must permit Chubby Club personnel to perform data entry in those systems where needed to support the Program.
2. Receipt Scanning
Where a Location participates through receipt scanning rather than a direct POS integration, the Location must:
- Ensure receipts are legible and contain the data required for verification.
- Train staff to assist Members with in-app receipt scanning at the point of sale.
3. Equipment and Connectivity
- Each Location is responsible for obtaining and maintaining all equipment, devices, software, and internet connectivity necessary to access and use the Platform.
- Each Location must maintain the confidentiality of its Platform account credentials and promptly report any suspected unauthorized access to legal@chubbyclub.com.
4. Data Sharing and Platform Data
- Each Location must share POS and transaction data with Chubby Club as needed for Program integration, reconciliation, and analytics.
- All Platform Data is owned by Chubby Club. Use of Platform Data by the Partner is governed by the Partner Terms (MSA) and the SaaS Terms.
5. Availability and Support
Chubby Club uses commercially reasonable efforts to make the Platform available 24 hours a day, 7 days a week, excluding scheduled maintenance and circumstances beyond its reasonable control.
Chubby Club classifies support issues by severity and responds as follows:
- Critical — the Platform, or a core Program function (points earning, redemption processing, or POS integration), is unavailable or materially inoperable for a Location, with no workaround. Critical issues are acknowledged promptly and worked continuously until resolved or a workaround is in place.
- Moderate — a Program function is degraded or intermittently failing, but a reasonable workaround exists and Members can still be served. Moderate issues are acknowledged and prioritized ahead of routine work, with regular status updates until resolved.
- Minor — cosmetic issues, general questions, and requests that do not impair Program operations. Minor issues are addressed in the ordinary course of support or as scheduled.
Specific response-time and availability targets, and any service credits, are set forth in the applicable Order Form.
6. Support Channel
Support requests and escalations should be submitted to legal@chubbyclub.com via the partner portal. When reporting an issue, include the Location name, a description of the issue, and its business impact so that severity can be assessed accurately.
7. Changes to This Policy
Chubby Club may update this policy from time to time. Material changes will be communicated to Partners through the partner portal or by email at least 30 days before they take effect, except where a shorter period is required to address fraud, security, or legal compliance. The “Effective date” above reflects the current version. Continued participation in the Program after a change takes effect constitutes acceptance of the change.
8. Relationship to Other Agreements
This policy is incorporated by reference into the Partner Terms (MSA) and applies to each Location identified in, and as provided by, the signed Order Form. These requirements complement, and do not replace, the SaaS Terms. In the event of a conflict, the order of precedence is: the signed Order Form, then the Partner Terms (MSA), then the SaaS Terms, then this policy.
